Terms & Conditions

1. “MyHBO Activity Contest” (the “Contest”) is organised by Home Box Office (Singapore) Pte Ltd (“HBO Asia”) and these Terms & Conditions shall apply to all stages of the Contest.

2. Eligibility:

   1. Only www.hboasia.com registered users with complete profile fields are eligible to participate in the Contest. The Contest does not apply to the following territories: India, Pakistan, Bangladesh and Maldives, being territories under www.hbosouthasia.com;
   2. HBO Asia, its contractors and agents and each of their immediate family members are not eligible to participate in the Contest;
   3. Eligible participants (“Participants”, and each, a “Participant”) who are below 21 years old must obtain their parent’s or legal guardian’s consent to participate in the Contest; and
   4. 1. A Participant who is a past winner of the Contest is not eligible to participate in the Contest; and
      2. The Participant agrees that if he/she is a past winner of the Contest, he/she may continue to select his/her favourite movies, rate them and set reminders to watch them, but will not be eligible to participate in the Contest.
3. As a condition to entry and participation in the Contest, each Participant represents, warrants and undertakes that he/she meets the eligibility requirements set out in Clause 2 above and he/she has read, understood, accepts and agrees to be bound by these Terms & Conditions and by the Contest rules (“Rules”).
4. The Participant acknowledges that he/she is aware that participation in the Contest is on an opt-out basis, and a failure to opt-out shall be deemed consent to participate in the Contest.
5. The Participant acknowledges and agrees that HBO Asia’s decision at all stages of the Contest is final and no enquiries or appeals shall be entertained. All Participants shall accept and abide by any, and all decisions made by HBO Asia concerning, without limitation, the Rules, the setting of question(s), selection of “secret” titles, allocation and computation of points, selection and award of winners and prizes and any other matters relating to the Contest.
6. Only winners of the Contest will be notified.
7. HBO Asia reserves the right to substitute the prizes offered. HBO Asia’s sole responsibility to a winner is to arrange for the delivery of the prize to the winner’s address as notified by the winner to HBO Asia. The winner acknowledges and agrees that (a) risk and title in and to the prize vests in the winner upon HBO Asia’s despatch of the prize; and (b) prizes are not exchangeable for cash, credit or kind.
8. In the event that the Participant emerges as a winner of the Contest, he/she hereby unconditionally and irrevocably grants HBO Asia the right to use his/her name and/or photo in HBO Asia’s marketing and promotional materials.
9. The Participant acknowledges and agrees that copyright and all intellectual property rights in and to the HBO, Cinemax and all other HBO channel brands, all program titles and visuals, photos, names and likenesses of program characters and/or performers appearing on the Contest and/or on www.hboasia.com (collectively, “HBO Property”) belong to HBO Asia and its affiliated/related companies (collectively, “HBO Companies”). The Participant shall not and has no right to use any HBO property in any way whatsoever.
10. Non-compliance with or breach of any of these Terms & Conditions or any Rules shall immediately disqualify the Participant from further participation at any stage of the Contest, and any prize won shall be forfeited, withheld or withdrawn.
11. HBO Asia reserves the right to amend or vary any of these Terms & Conditions and/or any Rules by posting the amendments on its website www.hboasia.com.
12. The Participant shall indemnify and keep each HBO Company indemnified against any and all loss, damage, claims and costs suffered and/or incurred by the HBO Company as a result of the Participant’s breach hereunder.
13. These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore.
