I ♥ FLIGHT OF THE CONCHORDS℠ Trailer Contest Terms & Conditions

1. “I ♥ FLIGHT OF THE CONCHORDS℠ Trailer Contest” (the “Contest”) is organised by Home Box Office (Singapore) Pte Ltd (“HBO Asia”) and these Terms & Conditions shall apply to all stages of the Contest.
2. Eligibility:
   1. To participate in the Contest, you (the “Participant”) must be a permanent resident in any of the following countries and be 18 years old and above, to participate in the Contest.
   2. HBO Asia, its contractors, agents and each of their employees and their immediate family members are not eligible to participate in the Contest.
3. The Participant shall ensure that his/her Contest submission (“Contest Submission”) satisfies the Rules (as defined in Clause 4(a) below) and all requirements set by HBO Asia including without limitation technical and format requirements.
4. As a condition to entry and participation in the Contest, each Participant agrees, represents, warrants and undertakes to HBO Asia that:
   1. He/she meets the eligibility requirements set out in Clause 2 above and he/she has read, understood, accepts and agrees to be bound by these Terms & Conditions and by the Contest rules (“Rules”);
   2. His/her Contest Submission does not and shall not contain anything which is an infringement of copyright or which is calculated to bring any HBO Company (as defined in Clause 9 below), FLIGHT OF THE CONCHORDS℠ program and any cast or character therein, into disrepute, breach of contract, duty of confidence or which is defamatory or in contempt of court;
   3. HBO Asia shall have the free, perpetual and worldwide right to use the Contest Submission by all means and in all media and formats whether now known or hereafter invented, for the purpose of promoting the FLIGHT OF THE CONCHORDS℠ program and any cast or character therein, the Contest and/or HBO Asia’s services; and
   4. In the exercise of its rights under Clause 4(c) above, HBO Asia shall have the discretion to edit, modify, add to or delete any part of each Participant’s Contest Submission at it deems fit.
5. The Participant acknowledges and agrees that HBO Asia’s decision at all stages of the Contest is final and no enquiries or appeals shall be entertained. All Participants shall accept and abide by any and all decisions made by HBO Asia concerning, without limitation, the Rules, the setting of question(s), selection and award of winners and prizes and any other matters relating to the Contest.
6. Only the winner of the Contest will be notified.
7. HBO Asia reserves the right to substitute the prize(s) offered. HBO Asia’s sole responsibility to a winner is to arrange for the delivery of the prize to the winner’s address as notified by the winner to HBO Asia. The winner acknowledges and agrees that (a) risk and title in and to the prize vests in the winner upon HBO Asia’s despatch of the prize; and (b) prizes are not exchangeable for cash, credit or kind.
8. In the event that the Participant emerges as a winner of the Contest, he/she hereby unconditionally and irrevocably grants HBO Asia the right to use his/her name and/or photo in HBO Asia’s marketing and promotional materials.
9. The Participant acknowledges and agrees that copyright and all intellectual property rights in and to the HBO, Cinemax and all other HBO channel brands, all program titles and visuals, photos, names and likenesses of program characters and/or performers appearing on the Contest and/or on www.hboasia.com (collectively, “HBO Property”) belong to HBO Asia and its affiliated/ related companies (collectively, “HBO Companies” and each, a “HBO Company”). The Participant shall not and has no right to use any HBO property in any way whatsoever.
10. Non-compliance with or breach of any of these Terms & Conditions and/or any Rules, shall immediately disqualify the Participant from further participation at any stage of the Contest, and any prize won shall be forfeited, withheld or withdrawn.
11. HBO Asia reserves the right to amend or vary any of these Terms & Conditions and/or Rules by posting the amendments on its website www.hboasia.com.
12. The Participant shall indemnify and keep each HBO Company indemnified against any and all loss, damage, claims and costs suffered and/or incurred by the HBO Company as a result of the Participant’s breach.
13. These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore.
